HookBook Terms of Use & Disclaimer

HookBook is owned and operated by RPM Experience Labs LLC (“RPMx,” “we,” “us,” or “our”). By creating an account, accessing, or using HookBook (the “App,” “Service,” or “HookBook”), you agree to be bound by these Terms of Use and Disclaimer (the “Terms”). If you do not agree, do not create an account or use the App.

You must be at least 13 years old to create an account or use HookBook. If you are between 13 and 17, you may use HookBook only with the permission and involvement of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use of the App. HookBook is not intended for, and we do not knowingly collect personal information from, children under 13. By creating an account you confirm that you meet these requirements.

HookBook is a young, actively improving product. Features may be added, changed, or retired as it grows, and the Service may occasionally be interrupted or updated. We may modify, suspend, or discontinue any part of the Service; if we ever discontinue HookBook entirely, we will make reasonable efforts to give you advance notice and a chance to export your content. Nothing in this section takes away rights you have under a paid plan — see Section 8.

The App and all of its concepts, designs, features, workflows, AI assistant (“Gilly”), content, branding, and underlying ideas are the exclusive property of RPM Experience Labs LLC (owner and operator of HookBook), and are protected by intellectual-property and other laws. You agree that:

• You will not copy, reproduce, distribute, publicly disclose, or share screenshots, recordings, or descriptions of unreleased features without written permission.
• You will not use, sell, license, or commercialize any of the App’s proprietary content or features.
• You receive no ownership or license rights in the App other than a personal, revocable right to use it for its intended purpose while these Terms are in effect.
• Any feedback, ideas, or suggestions you submit are voluntary and non-confidential. You grant RPM Experience Labs LLC a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use, modify, and commercialize them for any purpose, with no compensation, credit, or obligation to you. You acknowledge that HookBook may already be developing similar features, and that your submission creates no obligation or expectation between us.

Fishing, boating, and other outdoor activities are inherently dangerous and can result in serious injury, drowning, property damage, or death. You use HookBook entirely at your own risk. You agree that:

• You will not use the App while operating a boat, vehicle, or any equipment, or in any way that distracts you from your surroundings or safety.
• You are solely responsible for your own safety and the safety of others around you, for following all applicable laws and fishing/boating regulations, and for using appropriate safety equipment.
• HookBook is not responsible for any injury to you or others, loss of life, or damage to or loss of property or equipment (including phones or devices dropped, submerged, or damaged) arising from your use of the App or your activities while using it.

HookBook uses an AI assistant (“Gilly”) and other automated features. AI output may be inaccurate, incomplete, or inappropriate, and should not be relied upon as professional, safety, legal, navigational, weather, or regulatory advice. If you choose to start a catch from a photo, the photo may be analyzed by AI to suggest the species and approximate size; these are suggestions only, may be wrong, and are always yours to confirm or change. Always use your own judgment and verify important information independently.

You retain ownership of the catch logs, photos, and other content you submit (“Your Content”). You grant HookBook a license to store, process, and display Your Content as needed to operate the Service for you. When you log a catch with Gilly, we also save a transcript of that conversation — including the messages you type or speak — as part of Your Content, so HookBook can capture and build richer stories about your catches. To provide certain features (such as identifying a fish from a photo or looking up weather and location), Your Content may be processed by trusted third-party service providers acting on our behalf. GPS coordinates, your photos, and your conversation transcripts are kept private to your account and are not shared publicly unless you choose to share them. You are responsible for the accuracy and legality of Your Content. When you choose to share content publicly (for example, by creating a share link or a card), you are solely responsible for that content. Shared content reflects you, not HookBook, and the appearance of the HookBook name or logo on it does not mean HookBook created, reviewed, or endorses it. HookBook may remove any content or disable any share link at any time, including in response to a report.

HookBook is free to use, with one optional paid plan: Premium ($6.99/month or $59.99/year). Limited, launch-only founding offers (a rate-locked Founding Captain plan at $49.99/year and a one-time $249 Lifetime Captain purchase) may be available — Captain plans include the same features as Premium plus status benefits. Web billing is handled by our payment processor, Stripe; prices are in U.S. dollars and may exclude taxes shown at checkout.

• Free trial. Where offered, a free trial requires no card and does not auto-charge — for example, new accounts may receive full Premium for their first few Gilly logging sessions (or a limited number of days, whichever ends first); when it ends your account simply returns to the free version. You are never charged unless you start a paid subscription.
• Auto-renewal. Once you start a paid plan, it renews automatically at the end of each billing period at the then-current price until you cancel. We give advance notice of any renewal-price change as required by law. A one-time Lifetime purchase, where offered, does not renew.
• Cancel anytime. Cancel from your billing/manage area in the App (or via support). Cancellation stops the next renewal; you keep your paid features until the end of the period you already paid for, then return to the free version. Your data always stays.
• Refunds. Except where required by law, payments are non-refundable, and we do not provide refunds or credits for partial periods. If you were charged in error, contact support and we’ll make it right.
• App-store billing. If you ever subscribe through the Apple App Store or Google Play instead of the web, that store’s billing, renewal, cancellation, and refund terms apply, and you manage that subscription through your store account.
• Founding offers. Early supporters who take a founding offer keep the rate they signed up at for as long as their subscription stays active.
• Lifetime Captain. If we permanently discontinue HookBook within three (3) years of your Lifetime Captain purchase, we will refund a pro-rated portion of your one-time payment.
• Confirmations & reminders. We’ll email you a confirmation of your subscription terms when you subscribe, and a reminder before each annual renewal.

You agree not to misuse the App, attempt to access other users’ data, disrupt or overload the Service, reverse-engineer it, or use it for any unlawful purpose. You also agree not to upload, share, or transmit any content that is sexually explicit or pornographic, unlawful, infringing, hateful, harassing, threatening, or that depicts or identifies another person without their consent, or that you do not otherwise have the right to share. HookBook may remove content, disable share links, and suspend or terminate accounts that violate these Terms.

The App is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. HookBook does not warrant that the App will be uninterrupted, secure, or error-free. Some jurisdictions do not allow the exclusion of implied warranties or limitation of certain damages; to that extent, these limitations may not apply to you, and nothing in these Terms limits rights you have under applicable consumer law.

To the maximum extent permitted by law, RPM Experience Labs LLC, its affiliates, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, property, or for any personal injury, arising out of or relating to your use of (or inability to use) the App, even if advised of the possibility of such damages. To the maximum extent permitted by law, RPMx’s total liability for any claim will not exceed the greater of the amount you paid RPMx in the 12 months before the claim, or US $50. For Lifetime Captain purchases, the cap in this section is the full amount you paid.

You agree to indemnify and hold harmless RPM Experience Labs LLC and HookBook from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your content, your activities while using the App, or your violation of these Terms.

HookBook may update these Terms from time to time. If we make material changes, we will notify you (by email or in-app notice) at least 30 days before they take effect; continued use after the effective date constitutes acceptance. Changes will not retroactively reduce the pricing commitments of a plan you already purchased, and for any future changes to how disputes are resolved we will seek your affirmative agreement.

These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-laws rules. Any dispute arising out of these Terms or the App will be resolved exclusively in the state or federal courts located in Fulton County, Georgia, and each party consents to personal jurisdiction and venue there and waives any objection based on inconvenient forum.

If any provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary or severed, and the rest will remain in full effect. Sections 4–7 and 10–12 survive termination of your account. These Terms are the entire agreement between you and RPM Experience Labs LLC regarding the App. Our failure to enforce a provision is not a waiver of it. We may assign these Terms in connection with a merger, acquisition, or sale of assets; you may not assign them.
