HookBook Terms of Use & Disclaimer

HookBook is owned and operated by RPM Experience Labs LLC (“RPMx,” “we,” “us,” or “our”). By creating an account, accessing, or using HookBook (the “App,” “Service,” or “HookBook”), you agree to be bound by these Terms of Use and Disclaimer (the “Terms”). If you do not agree, do not create an account or use the App.

You must be at least 13 years old to create an account or use HookBook. If you are between 13 and 17, you may use HookBook only with the permission and involvement of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use of the App. HookBook is not intended for, and we do not knowingly collect personal information from, children under 13. By creating an account you confirm that you meet these requirements. If you are 13 to 17, your parent or guardian’s permission and involvement includes your use of the Cheering Section: who you invite, and whose invitations you accept. Accounts we learn belong to a child under 13 are closed.

HookBook is a young, actively improving product. Features may be added, changed, or retired as it grows, and the Service may occasionally be interrupted or updated. We may modify, suspend, or discontinue any part of the Service; if we ever discontinue HookBook entirely, we will make reasonable efforts to give you advance notice and a chance to export your content. Nothing in this section takes away rights you have under a paid plan — see Section 8.

The App and all of its concepts, designs, features, workflows, AI assistant (“Gilly”), content, branding, and underlying ideas are the exclusive property of RPM Experience Labs LLC (owner and operator of HookBook), and are protected by intellectual-property and other laws. You agree that:

• You will not copy, reproduce, distribute, publicly disclose, or share screenshots, recordings, or descriptions of unreleased features without written permission.
• You will not use, sell, license, or commercialize any of the App’s proprietary content or features.
• You receive no ownership or license rights in the App other than a personal, revocable right to use it for its intended purpose while these Terms are in effect.
• Any feedback, ideas, or suggestions you submit are voluntary and non-confidential. You grant RPM Experience Labs LLC a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use, modify, and commercialize them for any purpose, with no compensation, credit, or obligation to you. You acknowledge that HookBook may already be developing similar features, and that your submission creates no obligation or expectation between us.

Fishing, boating, and other outdoor activities are inherently dangerous and can result in serious injury, drowning, property damage, or death. You use HookBook entirely at your own risk. You agree that:

• You will not use the App while operating a boat, vehicle, or any equipment, or in any way that distracts you from your surroundings or safety.
• You are solely responsible for your own safety and the safety of others around you, for following all applicable laws and fishing/boating regulations, and for using appropriate safety equipment.
• HookBook is not responsible for any injury to you or others, loss of life, or damage to or loss of property or equipment (including phones or devices dropped, submerged, or damaged) arising from your use of the App or your activities while using it.

HookBook uses an AI assistant (“Gilly”) and other automated features. AI output may be inaccurate, incomplete, or inappropriate, and should not be relied upon as professional, safety, legal, navigational, weather, or regulatory advice. If you choose to start a catch from a photo, the photo may be analyzed by AI to suggest the species and approximate size; these are suggestions only, may be wrong, and are always yours to confirm or change. Always use your own judgment and verify important information independently. Gilly is not a person: Gilly’s replies, and Gilly’s voice, are generated by AI.

You retain ownership of the catch logs, photos, video clips, and other content you submit (“Your Content”). You grant RPM Experience Labs LLC a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, adapt (for example, resize or format), display and transmit Your Content solely to operate, secure and provide the Service. That includes showing it to the people you choose to share it with, including it and the first name on your profile in the notifications, emails and links HookBook sends at your request, and passing it to the service providers that deliver them. You confirm that you own Your Content or have every right and permission needed to share it, including permission from any person who appears or can be heard in it and, for a child, from the child’s parent or guardian. The license ends when you delete the content or your account, except for copies already delivered to others (such as a notification or email already sent, or something a recipient saved), backups for the period in our Privacy Policy, and content we leave in place to investigate a report or because the law requires it. When you log a catch with Gilly, we also save a transcript of that conversation — including the messages you type or speak — as part of Your Content, so HookBook can capture and build richer stories about your catches. To provide certain features (such as identifying a fish from a photo or looking up weather and location), Your Content may be processed by trusted third-party service providers acting on our behalf. GPS coordinates, your photos, and your conversation transcripts are kept private to your account and are not shared publicly unless you choose to share them. You are responsible for the accuracy and legality of Your Content. When you choose to share content publicly (for example, by creating a share link or a card) or with your Cheering Section, you are solely responsible for that content. Shared content reflects you, not HookBook, and the appearance of the HookBook name or logo on it does not mean HookBook created, reviewed, or endorses it. HookBook may remove any content or disable any share link at any time, including in response to a report. If a person shown or heard in Your Content, or a child’s parent or guardian, asks us to remove it, we may remove it without notice to you.

HookBook is free to use, with one optional paid plan: Premium ($6.99/month or $59.99/year). Limited, launch-only founding offers (a rate-locked Founding Captain plan at $49.99/year and a one-time $249 Lifetime Captain purchase) may be available — Captain plans include the same features as Premium plus status benefits. Web billing is handled by our payment processor, Stripe; prices are in U.S. dollars and may exclude taxes shown at checkout.

• Free trial. Where offered, a free trial requires no card and does not auto-charge — for example, new accounts may receive full Premium for their first few Gilly logging sessions (or a limited number of days, whichever ends first); when it ends your account simply returns to the free version. You are never charged unless you start a paid subscription.
• Auto-renewal. Once you start a paid plan, it renews automatically at the end of each billing period at the then-current price until you cancel. We give at least 30 days’ advance notice of any renewal-price change. A one-time Lifetime purchase, where offered, does not renew.
• Cancel anytime. Cancel with Manage billing on HookBook’s Premium page, in the App or on the web (or via support). Cancellation stops the next renewal; you keep your paid features until the end of the period you already paid for, then return to the free version. Your data always stays. Deleting your account also cancels your subscription right away.
• If a payment fails. If a renewal payment doesn’t go through, you keep your plan for 7 days while we try your card again. Update your card in Manage billing to keep it. If the payment still hasn’t gone through after 7 days, your account moves to the free version while we keep trying; once the payment goes through, your plan is back on and runs to the end of that billing period (your billing date stays the same). If the card still can’t be charged after the last try, the plan ends and we email you to let you know. Your data always stays.
• Switching to Lifetime Captain. If you buy Lifetime Captain while you have an active subscription, we end that subscription right away so you are never billed twice. Had time left on it? Contact us and we’ll refund the unused part.
• Deleting your account. If you delete your account while you have an active subscription, we cancel that subscription right away so you are never billed again. Had time left on it? Contact us and we’ll refund the unused part.
• Refunds. Except as described under Switching to Lifetime Captain and Deleting your account, and where required by law, payments are non-refundable, and we do not provide refunds or credits for partial periods. If you were charged in error, contact support and we’ll make it right. If your latest subscription payment is refunded in full, or you dispute it with your bank, your plan won’t renew: you keep it until the end of the period that payment covered. A partial refund doesn’t change your plan.
• App-store billing. If you ever subscribe through the Apple App Store or Google Play instead of the web, that store’s billing, renewal, cancellation, and refund terms apply, and you manage that subscription through your store account.
• Founding offers. Early supporters who take a founding offer keep the rate they signed up at for as long as their subscription stays active.
• Lifetime Captain. If we permanently discontinue HookBook within three (3) years of your Lifetime Captain purchase, we will refund a pro-rated portion of your one-time payment.
• Confirmations & reminders. We’ll email you a confirmation of your subscription terms when you subscribe, and a reminder about 30 days before each annual renewal. If you pay monthly, we’ll also email you a reminder once a year, about 30 days before each anniversary of your subscription.

You agree not to misuse the App, attempt to access other users’ data, disrupt or overload the Service, reverse-engineer it, or use it for any unlawful purpose. You also agree not to upload, share, or transmit any content that is sexually explicit or pornographic, unlawful, infringing, hateful, harassing, threatening, or that depicts or identifies another person without their consent, or that you do not otherwise have the right to share. That includes the sound in a video clip: music or other people’s voices you do not have the right to share. These rules apply to everything you enter that another person can see, including your profile name, the name you type for someone you invite, titles, captions, stories, and the names you give waters. You must not use a name that is obscene, hateful or threatening, or that pretends to be another person, a business, HookBook, or a public official. You must not share content that sexualizes or endangers a child, intimate images of any person without that person’s consent, graphic cruelty unrelated to lawful fishing, or another person’s private information such as a home address. You must not use invitations, sends or catch alerts to send advertising or spam, or to contact anyone you do not personally know or who has asked you to stop. You must not create or use another account to get around a block, a removal, a suspension or a ban. HookBook may remove content, disable share links, and suspend or terminate accounts that violate these Terms.Invitations and catch alerts. When you invite someone, and when you log or send something to your Cheering Section, HookBook sends an email or a notification at your request and on your behalf. It shows the first name on your profile and what you shared, and may appear on a lock screen or in a preview that neither you nor HookBook controls. You confirm that you personally know each person you invite, that you are allowed to give us their email address, and that they would expect to hear from you. Notifications are optional and are never used for advertising. Anyone can stop these messages at any time, and you agree not to invite again a person who has declined, opted out, removed you or blocked you.The Cheering Section. HookBook lets you share your catches with people you invite, and see the catches of people who invite you. There is zero tolerance for abusive, harassing, hateful or otherwise objectionable content or behavior in the Cheering Section. You can pause or remove anyone cheering for you at any time, and you can block or report anyone you cheer for from their page. Reports must be made in good faith; we do not tell the person reported who filed a report. HookBook does not review content before it is shared and has no duty to monitor it, though we may. We look at every report, and we aim to review every report within 24 hours. We may, in our judgment and without notice, remove or hide any content or name, turn off any share link, end any Cheering Section connection, remove a person from the Cheering Section, or suspend or close any account that we believe breaks these Terms or the law or puts someone at risk. If we close your account for a violation, you may not open another. We report apparent child sexual exploitation material to the National Center for Missing & Exploited Children as the law requires, and we may keep and disclose content and account information as described in our Privacy Policy.

The App is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. HookBook does not warrant that the App will be uninterrupted, secure, or error-free. Some jurisdictions do not allow the exclusion of implied warranties or limitation of certain damages; to that extent, these limitations may not apply to you, and nothing in these Terms limits rights you have under applicable consumer law.

To the maximum extent permitted by law, RPM Experience Labs LLC, its affiliates, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, property, or for any personal injury, arising out of or relating to your use of (or inability to use) the App, or the content or conduct of any other user, even if advised of the possibility of such damages. To the maximum extent permitted by law, RPMx’s total liability for any claim will not exceed the greater of the amount you paid RPMx in the 12 months before the claim, or US $50. For Lifetime Captain purchases, the cap in this section is the full amount you paid.

You agree to defend, indemnify and hold harmless RPM Experience Labs LLC and HookBook from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App; Your Content, including any claim that it infringes or violates another person’s rights or privacy; the invitations, emails and notifications sent at your request and your choice of the people who receive them; your activities while using the App; or your violation of these Terms or the law.

We may update these Terms from time to time. If we change the price of your plan or how billing, renewal, cancellation or refunds work for your subscription, we’ll tell you by email or in the app at least 30 days before the change applies to you. Other changes take effect when we post them, and we’ll note significant ones in the app’s What’s New. If you keep using HookBook after a change takes effect, the updated Terms apply. Changes will not retroactively reduce the pricing commitments of a plan you already purchased, and for any future changes to how disputes are resolved we will seek your affirmative agreement.

These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-laws rules. Any dispute arising out of these Terms or the App will be resolved exclusively in the state or federal courts located in Fulton County, Georgia, and each party consents to personal jurisdiction and venue there and waives any objection based on inconvenient forum.

If any provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary or severed, and the rest will remain in full effect. Sections 4–7 and 10–12 survive termination of your account. These Terms are the entire agreement between you and RPM Experience Labs LLC regarding the App. Our failure to enforce a provision is not a waiver of it. We may assign these Terms in connection with a merger, acquisition, or sale of assets; you may not assign them.

To report content, a person, or an email you did not want, write to support@hookbook.ai. If a photo or video clip of you or your child was shared without permission, tell us at privacy@hookbook.ai (support@hookbook.ai works too) and we will remove it as quickly as we can, and within 48 hours where the law requires it.Copyright. If you believe content on HookBook infringes your copyright, send a notice to our designated agent: Copyright Agent, RPM Experience Labs LLC, 650 Ponce De Leon Ave NE, Ste 300 #2161, Atlanta, GA 30308; phone 404-941-4833; copyright@hookbook.ai. Include your signature; the work you say is infringed; the content and where it is (the link); your contact details; a statement that you believe in good faith the use is not authorized; and a statement, under penalty of perjury, that your notice is accurate and you are authorized to act. We remove content when we receive a valid notice, tell the person who posted it, and accept counter-notices as the law provides. We close the accounts of repeat infringers in appropriate circumstances.
